TERMS AND CONDITIONS

  • Macuira Tours S.A.S. reserves the right to make modifications to the plan or tourist service contracted in events of force majeure or fortuitous case.
  • In case of delays in the beginning of the service for reasons external to the travel agency, the agency reserves the right to make changes in the itinerary, accommodations of similar or higher category, transportation and others that are necessary to ensure the success of the trip.
  • The care of personal belongings is the sole responsibility of the traveler, as long as they are not in the custody of the tour operators or transportation companies.

  • Travel assistance services include medical assistance in case of accident up to COP 15,000,000, transfer and stay of companion in case of accident or accidental death COP 2,000,000, compensation for accidental death or disability up to COP 50,000,000.   • Reservations are confirmed with the payment of 20% of the total amount of the service, and up to 15 days before the tour starts.
  • Unless expressly stated otherwise in the conditions of the tour plan, Macuira Tours S.A.S. assumes no responsibility for events such as accidents, strikes, riots, earthquakes, climatic or natural phenomena, security conditions, political factors, denial of entry permits, health issues and any other case of force majeure that may occur during the trip and only undertake to provide services and make refunds as appropriate according to our policies.
  • Macuira Tours S.A.S. reserves the right to make changes in the itinerary, especially in rainy seasons due to changes in road conditions.
  • Refunds to users in the cases provided for in Articles 63, 64 and 65 of Law 300 of 1996 and Article 4 of Decree 2438 of 2010, will be made no later than thirty (30) calendar days from the date on which the claim was made to the agency or the date of the enforcement of the decision issued by the Ministry of Commerce, Industry and Tourism in which imposes such obligation to the provider.
  • In case of exercising the right of withdrawal Macuira tours will deduct from the total value of the plan a twenty percent corresponding to the management and financial expenses incurred by the agency for the reservations for the provision of the service.

RECOMMENDATIONS

  • Get vaccinated against yellow fever at least 15 days before traveling. The vaccine is not suitable for HIV-positive people, pregnant women and children under 6 months of age.
  • For travel to jungle regions or natural parks, other vaccinations are also recommended, such as tetanus and hepatitis A and B vaccines. It is recommended that foreigners coming from countries that have the dengue vaccine be vaccinated before traveling if they are going to visit places below 1,800 meters above sea level.
  • Keep in mind that the average temperature ranges between 29 and 34 degrees Celsius with a maximum of 40 degrees Celsius.
  • Cabo de la Vela is a beautiful place, which is still in its natural habitat, its cabins are typical Wayúu, built in mud and Yotojoro, there you will not find the normal tourist hotel infrastructure, but you will find everything required to make it an unforgettable visit.
  • The Wayuu handicrafts are beautiful, it is advisable to buy Chinchorros, backpacks and hats produced by the indigenous people of this area.
  • Carry small luggage for comfort, the availability of space for this is very limited.
  • There is only Claro and Movistar coverage in the high Guajira.
  • Dispose of solid waste in authorized places or in biodegradable bags.

RESPONSIBILITY

  • Macuira Tours S.A.S., in its capacity as intermediary has limited responsibility in the provision of tourist services of the suppliers (hotels, transportation, guides, parks, museums, among others), likewise, it has no interference in the decisions or policies of the same. On the other hand, it is responsible for the fulfillment of the services mentioned in the programs.
  • In the event that the user, due to force majeure, is forced to suspend the contracted tourist services, he/she will be entitled to the reimbursement of the services not enjoyed, except for the expenses that have been caused or will be caused later due to the cancellation. The death, serious illness or accident of the insured, spouse, children, parents or siblings shall be understood as force majeure, which shall exempt the consumer from liability.
  • In case of not taking the contracted services without justified cause, the consumer shall not be entitled to any refund of the amount paid, unless otherwise agreed between the parties.
  • In the event that the user of the contracted program cannot travel on the reserved date, he/she may coordinate a new travel date, assuming the costs that this means as a penalty depending on how far in advance the new date is reported, or he/she may transfer his/her reservation to a third person, requesting it in writing fifteen days prior to the travel date.
  • The organizers of the tourist services reserve the right to withdraw from these who for serious cause, duly proven, whether of moral or disciplinary character, attempts against the success of the same.
  • The organizer of the tourist services and the travel agency do not assume any responsibility for legal matters or other inconveniences in which the user may be involved, in the event that the user is forced to withdraw from the excursion for such reasons and will pay the expenses incurred.
